Former lecturer acquitted and free from a jail term of 6 years
5:24:00 PMSHAH ALAM: The Shah Alam High Court today acquitted and discharged a former lecturer of Universiti Kebangsaan Malaysia six-year jail sentence passed on him in 2009.
Judge Datuk Siti Mariah Ahmad while reading his decision, said Sessions Court Judge erred in fact and law when mensabit and sentenced the appellant.
Shaharuddin Aziz, now 62, was sentenced to six years' imprisonment on December 3, 2009 by the Ampang Sessions Court after conviction under Section 420 of the Penal Code.
He is accused of deceiving a dealer, Cheah So on involving money worth U.S. $ 300,000 (RM1.14 million) in the Office of the Company consciousness Timor Sdn Bhd, Taman Melawati in February 1996

The appellant alleged deceptive Cheah to believe that he is the holder of Power of Attorney or Power of Attorney for the land area of 27 hectares owned by States Friendly Setia (M) Sdn Bhd at Lot Mukim Sungai Buloh, Perlis.
The land is said to be developed as residential areas after obtaining Bank Guarantee bids amounting to RM6 million from the Public Bank branch Kangar, Perlis.
Shaharuddin allegedly led Cheah to hand the money U.S. $ 300,000 through bank draft Bumiputra Commerce Bank Bhd, a branch Leboh Coast, New South Wales for the purpose of obtaining approvals of the Bank Guarantee amounting to RM6 million.
Siti Mariah said after studying the oral and written arguments in the appeal are found all payments between the appellant with Cheah is based on a memorandum of understanding agreed to by both parties.
